For Employers with Massachusetts Employees

A Massachusetts Superior Court has ruled that commissions are NOT due and payable as wages “until all contingencies have been met,” in accordance with the Massachusetts Wage Act. A case in point was that of a travel planner whose contract was terminated before some of the trips he had planned were taken. Because not ALL of his obligations had been fulfilled (even though they had been planned), his commission was not payable.

Employers with contract employees in other states might be well-advised to check on those states’ regulations.
