New Illinois Requirement for Employers with 15 or more Employees

Effective June 1, 2026, the People’s Republic of Illinois will require covered employers to provide up to 10 days of unpaid leave to employees when their child is a patient in a Neonatal Intensive Care Unit (NICU). Employers will be permitted to require reasonable documentation/verification of the length of the stay of the child in NICU – with the exception of any confidential information protected by HIPAA or any similar law. Employers with over 50 employees must provide up to 20 days of leave.
