EEOC Says Agencies May Issue Bathroom Policies That Restrict Trans Federal Workers

In February, the EEOC ruled that federal agencies may require transgender employees to use bathrooms and similar “intimate spaces” that correspond to their sex at birth, and not to their identity. This decision is based upon the requirement of Title VII that agencies treat transgender employees the same as non-transgender employees. 

It is noted that opinions are all over the place, so employers should consult counsel should any relevant questions arise.
