Amazon Up a River

Amazon in California was found guilty of an FLSA violation for not paying a new hire for participation in new-hire events. In addition to new-hire processing, the person – after having completed her application, I-9 and drug test and receiving her badge – was required to be photographed and to watch an orientation presentation. She claimed that whole time period should have been compensated. The judge in the case ruled that the process up through granting of the badge was indeed not compensable, BUT that the photo and presentation time should have been compensated because she was, in effect, an employee at that time, having been given a badge. In addition to that employee, all personnel in that situation have now been granted class action certification.
