More on AI – Regulation Growing … maybe not fast enough

A number of different states and localities have passed legislation or regulations limiting the use of artificial intelligence (AI) in different situations. AI has been used to spoof interviewees, for example, successfully fooling interviewers. “Workado,” a company advertising falsehood detection software recently settled with the FTC after its detection software, which was advertised as being “98 percent accurate” turned out to be about 53 percent accurate. They are not alone, but a lot of good is coming from the use of AI as well. Employers are well-advised to use caution, however. 

As noted above, certain “tells” can be used to spot AI interviewees. These include the following: 

  • Have the interviewee move their head or hands in view of the camera, which normally will not be replicated accurately.

  • Watch for unnatural eye movements/side glances and/or delays.

  • Responses that are either “generic” or (conversely) “too polished” or “sterile” for the situation can be an indicator.
