Some Election Impacts on US Business

All elections have impacts on society, and the one last November has certainly proven to be no different in the employment arena (among others).

EEOC has suspended pursuit of gender identity lawsuits, and many local jurisdictions are reversing their stance on transgender individuals in women’s athletics. The NLRB has rescinded a number of Biden-era guidance documents addressing such areas as workplace surveillance, artificial intelligence implementation, a make-whole order for employees under non-compete agreements (according to that administration’s interpretation of the NLRA), potential employee status of NCAA athletes, etc. The reason given for the recissions is the increased backlog of cases received during the Biden administration. It was noted that the same kind of suspension had happened after the first Trump administration as well and that all cases will eventually be adjudicated.
